February 5, 2008 Los Angeles, California –
From: http://www.earthfiles.com/news.php?ID=1383&category=Environment

The National Resources Defense Council reports that on February 4, 2008, “a federal court struck down a waiver issued by the White House purporting to exempt the U.S. Navy from complying with a bedrock environmental law during sonar training exercises off southern California. [ See Earthfiles More Information below.]

“In nullifying the waiver, the court reaffirmed an injunction issued early in January, requiring the Navy to reduce harm to whales and other marine mammals from sonar training. The Navy has acknowledged that the high-intensity, mid-frequency sonar at issue can injure and kill whales and other marine mammals.

‘The Court has affirmed that we do not live under an imperial presidency,’ said Joel Reynolds, Director of the Marine Mammal Protection Project at NRDC, which obtained the injunction against the Navy. ‘The Navy doesn’t need to harm whales to train effectively with sonar. By following the carefully crafted measures ordered by the court, the Navy can conduct its exercises without imperiling marine mammals.’

“On January 15, President Bush issued the Navy an unprecedented waiver under the Coastal Zone Management Act (CZMA), and allowed the Navy an ‘emergency’ waiver under the National Environmental Policy Act (NEPA), for a series of training exercises involving high-intensity, mid-frequency sonar now underway. Those statutes are the basis of a January 3, 2008, injunction issued by U.S. District Court Judge Florence-Marie Cooper, requiring the Navy to monitor for and avoid marine mammals while operating sonar during the SOCAL naval exercises.”

In rejecting the Bush administration’s waiver under NEPA, Judge Cooper wrote:

“The Navy's current ‘emergency’ is simply a creature of its own making, i.e., its failure to prepare adequate environmental documentation in a timely fashion.” Judge Cooper later added that the Navy's position “produces the absurd result of permitting agencies to avoid their NEPA obligations by re-characterizing ordinary, planned activities as ‘emergencies’ in the interests of national security, economic stability, or other long-term policy goals. . . . This cannot be consistent with Congressional intent.”

In addition, although Judge Cooper expressed “significant concerns about the constitutionality of the President’s exemption of the Navy from the requirements of the Coastal Zone Management Act,” she wrote that no finding on the issue is necessary because the “Court is satisfied that its injunction stands firmly on NEPA grounds.”

The court also reaffirmed its January 3 injunction, which requires the Navy to maintain a 12 nautical mile no-sonar buffer zone along the California coastline; to avoid other key whale habitat; to shut down sonar when marine mammals are spotted within 2,000 meters; and to monitor for marine mammals using various methods, among other measures. More than one year ago, the California Coastal Commission had urged the Navy to adopt similar protective measures during these exercises, finding them necessary to bring the training exercises into compliance with California’s coastal laws.

The high-intensity MFA sonar system can blast vast areas of the oceans with dangerous levels of underwater noise and has killed marine mammals in numerous incidents around the world. The waters off Southern California have some of the richest marine habitat in the country, and include five endangered species of whales, a globally important population of blue whales, the largest animal ever to live on earth, and as many as seven individual species of beaked whales, which are known to be particularly vulnerable to underwater sound.

“It is a bedrock principle of our government that neither the military nor the president is above the law,” said Richard Kendall, a senior partner at the Los Angeles law firm of Irell & Manella, and co-counsel with NRDC in the lawsuit. “Judge Cooper has upheld that fundamental doctrine.”

NRDC was joined in the lawsuit by the International Fund for Animal Welfare, Cetacean Society International, League for Coastal Protection, Ocean Futures Society, and Jean-Michel Cousteau.

The Natural Resources Defense Council is a national, nonprofit organization of scientists, lawyers and environmental specialists dedicated to protecting public health and the environment. Founded in 1970, NRDC has 1.2 million members and online activists, served from offices in New York, Washington, Chicago, Los Angeles, San Francisco and Beijing.

SYDNEY, Australia (Reuters) -- Australian scientists have discovered a giant underwater current that is one of the last missing links of a system that connects the world's oceans and missing links.

The newly discovered current sweeps past the island of Tasmania (pictured) towards the Southern Atlantic.

New research shows that a current sweeping past Australia's southern island of Tasmania toward the South Atlantic is a previously undetected part of the world climate system's engine-room, said scientist Ken Ridgway.

The Southern Ocean, which swirls around Antarctica, has been identified in recent years as the main lung of global climate, absorbing a third of all carbon dioxide taken in by the world's oceans.

"We knew that they (deep ocean pathway currents) could move from the Pacific to the Indian Ocean through Indonesia. Now we can see that they move south of Tasmania as well, another important link," Ridgway, of the Commonwealth Scientific and Industrial Research Organisation, told Reuters.

In each ocean, water flows around anticlockwise pathways, or gyres, the size of ocean basins.

The newly discovered Tasman Outflow, which sweeps past Tasmania at an average depth of 800-1,000 meters (2,600 to 3,300 feet), is classed as a "supergyre" that links the Indian, Pacific and Atlantic southern hemisphere ocean basins, the government-backed CSIRO said in a statement on Wednesday.

The CSIRO team analyzed thousands of temperature and salinity data samples collected between 1950 and 2002 by research ships, robotic ocean monitors and satellites between 60 degrees south, just north of the Antarctic Circle, and the Equator.

"They identified linkages between these gyres to form a global-scale 'supergyre' that transfers water to all three ocean basins," the CSIRO said.

Ridgway and co-author Jeff Dunn said identification of the supergyre improves the ability of researchers to more accurately explain how the ocean governs global climate.

"Recognizing the scales and patterns of these subsurface water masses means they can be incorporated into the powerful models used by scientists to project how climate may change," Ridgway said in a statement.

The best known of the global ocean currents is the North Atlantic loop of the Great Ocean Conveyer, which brings warm water from the Equator to waters off northern Europe, ensuring relatively mild weather there. Scientists say if the conveyor collapsed, northern Europe would be plunged into an ice age.

Earlier this year, another CSIRO scientist said global warming was already having an impact on the vast Southern Ocean, posing a threat to myriad ocean currents that distribute heat around the world.

Melting ice-sheets and glaciers in Antarctica are releasing fresh water, interfering with the formation of dense "bottom water", which sinks 4-5 kilometers to the ocean floor and helps drive the world's ocean circulation system.

A slowdown in the system known as "overturning circulation" would affect the way the ocean, which absorbs 85 percent of atmospheric heat, carries heat around the globe, Steve Rintoul, a senior scientist at the CSIRO Division of Marine and Atmospheric Research, said in March.

But as the Mayan Riviera gets more and more developed, popular, and Americanized, I'm starting to look for a new and off-the-beaten-path tropical Eden. Has anyone been to, or heard about, Playa Sonrisa? http://www.playasonrisa.com/

It's quite a bit further south, 240 miles south of Cancun, so quite a trek from the nearest airport. But it sounds really amazing, secluded, and pretty much clothing-optional.

I'd love to find someone who's spent time there.

Ward Island off of Toronto was very interesting from a nature and sounds point of view with frogs and birds, the wind, the sound of racing lazers, a voice or two in the distance. Fresh wood gnawed by beavers had amazing textures. There was drift wood on the beach and garter snakes in the underbrush. When one sits on the sand, even in a brisk wind, the sand is warm and frogs can be heard in the nearby marsh.

Hi

I've just released a new documentary film about Grenada. Here is more info.

GRENADA: THE MAROON SPIRIT, a new documentary film by Pumpkinhead Production Company to donate portion of sales to Grenada Maroon Fund

What happens when a small Caribbean island is hit by a massive hurricane? How does a country cope when 90% of their homes are destroyed or damaged? What happens when your agricultural sector is wrecked and your major export crop will take years to recover? What are the hopes of the people for the future under such conditions? These are some of the questions that GRENADA: THE MAROON SPIRIT hopes to answer for people. This new production by the Pumpkinhead Production Company was filmed on the island of Grenada in the Eastern Caribbean in November of 2004, two months after Hurricane Ivan devastated the island nation on September 7.

Traveling throughout Grenada and its sister island of Carriacou, GRENADA: THE MAROON SPIRIT interviews people from all walks of life, hearing about their experiences with the deadly hurricane and their efforts to rebuild their lives. They tell of the deadly winds, the flying debris and the resulting destruction. Their stories of working together with their neighbours, as a community to quickly get back on their feet are inspiring and educational. They credit Hurricane Ivan with rekindling the “Maroon Spirit” amongst the population. The actual live footage of Hurricane Ivan shows the deadly force that these brave people had to face.

The film places Hurricane Ivan within a historical context by interviewing two of Grenada’s foremost historians, author and historian George Brizan and Beverly Steele, author and Head Tutor at T.A. Marryshow House, Grenada campus of the University of the West Indies about Grenada’s past. This is a past that includes mass suicides, civil wars, dictatorships, revolutions, and invasions. Brenda Hood, Minister of Tourism, tells of the hurricane’s affect on the government and its efforts to rebuild their country.

GRENADA: THE MAROON SPIRIT is a fifty-minute documentary film. It is the first feature length film by the Pumpkinhead Production Company, an independent film production house located in New Westminster, British Columbia, Canada. The DVD is being sold online at www.grenadamaroonspirit.com or by mailing Pumpkinhead Production Company, P.O. Box 283, 720 6th Street, New Westminster, BC V3L 3C5. Pumpkinhead is committed to donating a portion of every sale to the Maroon Spirit Fund to aid in Grenada’s recovery.

Plastic cannot biodegrade!!!

"The National Academy of Sciences estimates that 6.4 million tons of litter enter the world's oceans each year. Globally, plastic accounts for 60 to 95 percent of that waste, according to a 2002 report in the "Marin Pollution Bulletin," by J.G.B. Derriak. According to the US Environmental Protection Agency, 5.5 percent of the plastic consumed int he US in 2001 was recycled.

Hannah Nevins, beachcomber coordinator with Moss Landing Marine Laboratories, has found many dead seabirds' stomachs stuffed with plastic. Scientists don't know whether the plastic is poisoning the birds or if they're simply starving to death because the material is blocking their access to pray. Moore said laysan albatross chicks are also frequent victims of plastic-bounty starvation. "They die from false feelings of satiation, which result from being fed bottle caps, cigarette lighters, and toys, which they cannot regurgitate so they stop begging their parents for food." There are a whole bunch of chemicals in plastics that mimic estrogen," Ebbesmeyer said. "If a male mammal ingests them, you're altering the balance between testosterone and estrogen and you wind up with populations worldwide where the males are becoming less male." Marine debris has adversely affected at least 267 species worldwide including 86 percent of sea turtle species, 44 percent of sea bird species and 43 percent of marine mammal species, primarily through ingestion, starvation, suffocation and entanglement, according to D.W. Laist in the book "Marine Debris-Sources, Impacts and Solutions."

In the ocean, where the plastic rises to the surface, there are gyres - where high pressure zones swirl currents together "like a toilet that never flushes", according to Moore. Scientists have given gyres nicknames, like "Eastern Garbage Patch." One such gyre is reported to span 10 million square miles, which makes it as large as Africa.

...it was all GOOD FUN being a beach bum occasionally & people watch!

it's not as bad a 'terrorist' country as we perceive it to be. security is very tight & an eye opener for one & all to check out the scene...

i've also posted 2 new beach pictures in da album..

We would consider camping or somewhat inexpensive lodging, and are trying to avoid places overly packed with tourists, screaming children, radios, etc. We enjoy natural settings. Places where bathing suits are optional are even better!! Any suggestions anyone??????

I'm just back from Miami Beach (south beach), and the beach there is great for running. I guess lots of trucks, etc. drive up and down so the sand is really hard and flat.. There were lots of other folks running and jogging out there too.
I'm in northern cali. and does anyone know of a good beach for running?

i went surfing at Zuma beach, California.
we saw our usuall porpoise activity, which happens almost every time, so even though its amazing, its kinda par for the course. But today, the porpoise had to be the oldest bunch in the waters. they were twice as big as any we've ever seen, and they just looked ancient. there must have been some food nearby, cause they just sorta floated around us for a while. not alot of swimming, just hanging with us. at one point, there were 3 or 4 under my friend greg, and then they just popped up all around him. it was amazing.
but even cooler for me, was this cute little seal, who chose to hang with me. out of all my years in the ocean, i've never been in with a seal. i've seen them from the shore, but this little fellow wanted to be my friend. i barked a little at him, and he stayed with me for about 10 minutes. he would swim within 5 feet of me, and i just told him how beautiful he was, and it was kinda like he understood, and just wanted the compliments. he swam under me and all around me, just checking me out - and i had the strangest urge to pet him. i didn't, but at one point, he actually came over to me, and cocked his head like he wanted me to. it was so sweet, and i just had to share. it really validated my love for the ocean, and the beach, and if anyone would like to get more involved with keeping it preserved, go check out www.blueoceaninstitute.org. a surf buddy of mine is partially responsible for this whole outfit, and they are doing great work. hope all of you had some time at the beach this weekend!
sami:)
ps - i just reread this before posting, and didn't want you all to think i'm luring you to check out this site with the cool story. its just that i'm getting more passionate with age, to preserve the beaches we're all here to love. :)
